{"id":3076,"date":"2017-06-20T16:31:37","date_gmt":"2017-06-20T20:31:37","guid":{"rendered":"http:\/\/transcourt.com\/?p=3076"},"modified":"2025-06-24T14:32:22","modified_gmt":"2025-06-24T18:32:22","slug":"supreme-court-denies-lawsuit-challenging-the-use-of-elds","status":"publish","type":"post","link":"https:\/\/transcourt.com\/fr\/2017\/06\/supreme-court-denies-lawsuit-challenging-the-use-of-elds\/","title":{"rendered":"Supreme court denies lawsuit challenging the use of ELDs"},"content":{"rendered":"<div style=\"width: 1210px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium\" src=\"https:\/\/www.overdriveonline.com\/wp-content\/uploads\/sites\/8\/2016\/05\/ELD-by-James-2016-05-03-13-23-1200x864.jpg\" width=\"1200\" height=\"864\" alt=\"ELD-by-James\" \/><p class=\"wp-caption-text\">Curtesy of overdriveonline.com<\/p><\/div>\n<p>In favour of the U.S. Department of Transportation, the U.S. Supreme Court decided it would not hear a lawsuit that challenges a ruling that requires truck operators to use an electronic logging device to track hours of service.<\/p>\n<p>The Owner-Operator Independent Drivers Association was behind the lawsuit and a member of legal counsel said the organization was disappointed that the Supreme Court did not review the case.<\/p>\n<p>The association will continue to press the issue in Congress and with the Trump Administration.<\/p>\n<p>The American Trucking Association is in agreement with the Supreme Court\u2019s decision, saying it supports the FMCSA as it works toward the December deadline for electronic logging devices.<\/p>\n<p>The OOIDA sought to have the mandate struck down in court, indicating ELDs violate a drivers constitutional rights and protections against warrantless searches and seizures, and that the rule did not meet the stipulations set for an ELD mandate.<\/p>\n<p>The lawsuit was brought against the DOT in March 2016, and a three-judge panel on the Chicago-based 7<sup>th<\/sup> Circuit Court of Appeals heard the case last September. The following month, it ruled in favour of the DOT, and dismissed the arguments of the case.<\/p>\n<p>In April of this year, the OOIDA filed a writ of certiorari asking the Supreme Court to take up the case.
